原告XX委员会诉被告赵XX其他所有权纠纷一案,本院于2012年6月28日立案受理后,依法适用简易程序,于2012年8月30日公开开庭进行了审理。原告委托代理人王XX、被告赵XX到庭参加诉讼。本案现已审理终结。

原告XX委员会诉称,2009年1月14日,经上海市浦东新区桃林路18号YY广场业主大会讨论,《YY广场专项维修资金管理规约》经全体业主投票通过。根据该规约第一项规定:业主应当按照本规约约定缴纳维修资金,并按照第二条第二款按房屋建筑面积缴纳人民币35.94元/平方米(以下币种相同)的维修资金。被告系上海市浦东新区XX路XX号XX楼XX室的房屋产权人,共需缴纳维修资金4,194.56元。原告发函催讨未果,现起诉来院要求判令:1、被告缴纳维修资金4,194.56元;2、被告支付滞纳金(以4,194.56元为本金,自2009年1月14日至判决生效之日止,按中国人民银行同期贷款利率计算)3、被告承担本案诉讼费。

被告赵XX辩称,其为上海市浦东新区桃林路XX号XX楼XX室房屋业主,该房屋面积为116.71平方米。其未支付过维修基金,但不同意支付滞纳金。其从未投票过选举过业主委员会,业主委员会从未与其沟通缴纳维修基金事宜,故不清楚缴纳维修基金的情况。被告要求知晓缴纳维修基金的原因及用途,需了解缴纳维修基金是否合理及用途后,再决定是否缴纳。

经审理查明,2009年1月14日,上海市浦东新区YY广场业主大会会议讨论通过《YY广场专项维修资金管理规约》。该规约约定,业主应当按照规定和本规约约定缴纳维修资金。原未缴纳首期维修资金的业主,根据房屋建筑面积,按35.94元/平方米一次性缴纳。被告系上海市浦东新区XX路XX号XX楼XX室房屋产权人,该房屋建筑面积为116.71平方米。

另查明,系争房屋购房人应缴纳的维修资金为4,194.56元,现尚未缴纳。

以上事实,由原告提供的《YY广场专项维修资金管理规约》、上海市房地产登记簿、挂号信交寄清单、YY广场专项维修资金催缴通知书、律师函、维修资金缴纳查询等证据及双方当事人的当庭陈述在案佐证。

本院认为,小区业主设立的业主大会,选举的业主委员会,代表全体业主就小区建筑物及其附属设施的相应事项进行作出决定、进行管理,其决定对业主具有约束力。上海市浦东新区YY广场业主大会会议讨论通过的《YY广场专项维修资金管理规约》涉及筹集和使用小区维修资金等事宜,对全体业主均具有约束力。现被告未缴纳维修资金,故原告依据规约的约定向被告主张缴纳首期维修资金并无不当,本院予以支持。至于原告主张的滞纳金,因《YY广场专项维修资金管理规约》中并未约定维修资金的缴纳时限以及逾期缴纳将产生滞纳金,因此原告的该项主张缺乏依据,本院不予支持。根据《中华人民共和国物权法》第七十五条、第七十六条、第七十八条之规定,判决如下:

一、被告赵XX应于本判决生效之日起十五日内支付原告XX委员会维修资金人民币4,194.56元;

二、驳回原告XX委员会的其余诉讼请求。

负有金钱给付义务的当事人如未按判决指定的期间履行给付义务,应当依照《中华人民共和国民事诉讼法》第二百二十九条之规定,加倍支付迟延履行期间的债务利息。

案件受理费人民币50元,减半收取计25元,由被告赵XX负担。

如不服本判决,可在判决书送达之日起十五日内,向本院递交上诉状,并按对方当事人的人数提出副本,上诉于上海市第一中级人民法院。
